業主與立案法團交涉 宜留下紀錄 [2012-01-16]

華人消費者協會投訴組負責人陳作人表示,柏文及城市屋的業主立案法團每月要開一次會議,每年也要開周年會議,這些會議都須有紀錄留下;柏文業主最好每次會議都參加,以瞭解物業情況,這是業主的權利。

 

以新聞報道中的案例,陳作人認為,按理說,只有涉及「錢」的因素,法院才能判決命令業主賣房子,例如管理費拖欠不繳;如果是吵鬧,且有多戶投訴,一般而言,業主立案法團做出告官的決定時,一定會有開會紀錄,業主可以要求查閱。而案子送進法院前,業主立案法團的主席有責任告知業主,並把法院的文件交一份給業主,讓對方能夠出庭聆訊。

 

業主不服可上訴

 

一經法院判決確定要賣房時,業主如果不服,也可以去法院要求看法庭文件,並且上訴,要求聆訊。

 

陳作人還說,業主在與業主立案法團溝通時,最好能以「電郵」或書信方式進行;同時,要回覆信件,也要直接在來信上按「回覆」(reply),並要求對方一定時間內回覆,不要重寫一封電郵,因為這才有「連貫性」,是有法律作用的,他提醒,與業主立案法團如果有爭拗,千萬不要以見面或打電話的方式,除非你有錄音,但錄音也不見得能獲法官接受作為呈堂證供。
